1. Acceptance of Terms

By accessing or using TweetStream, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service. You must be at least 18 years old to use TweetStream. By using our service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

TweetStream is a Twitter relay service that allows users to access and interact with Twitter content through our platform. We are not affiliated with Twitter/X Corp. We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice. You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

2.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your API keys. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials. You are solely responsible for all activities that occur under your account.

3. Third-Party Content and Data Sources

TweetStream relays content from Twitter/X and other third-party sources through licensed data providers. We do not create, control, verify, or endorse any third-party content. All content displayed through our service remains the intellectual property of its original creators and is subject to the terms and conditions of the originating platform. You access and use third-party content entirely at your own risk. We make no representations or warranties regarding the accuracy, completeness, timeliness, or reliability of any third-party content.

3.1 Twitter/X Platform Compliance and Disclaimer

IMPORTANT: TweetStream does not directly access, scrape, crawl, or utilize Twitter/X Corp's API or services. We do not have any direct relationship, partnership, or affiliation with Twitter/X Corp. All Twitter/X content available through our service is obtained exclusively through independent, licensed third-party data providers who maintain their own separate relationships and agreements with content sources. By using our service, you expressly acknowledge and agree to:

• TweetStream is an independent service and is NOT affiliated with, endorsed by, or sponsored by Twitter/X Corp in any way
• You will comply with Twitter/X Corp's Terms of Service (https://x.com/tos) when viewing or interacting with any content originating from Twitter/X
• You will NOT use our service to circumvent, evade, or bypass any access restrictions, rate limits, or technical limitations imposed by Twitter/X Corp
• You will NOT use our service to scrape, harvest, collect, or aggregate Twitter/X content in violation of Twitter/X Corp's terms
• You acknowledge that Twitter/X Corp may change their policies at any time, which may affect our data providers and consequently our service availability
• You acknowledge that we have no control over and accept no responsibility for actions taken by Twitter/X Corp or our data providers
• You understand that any dispute you have regarding Twitter/X content is between you and Twitter/X Corp, not TweetStream

3.2 Twitter/X Trademarks and Intellectual Property

Twitter, X, the X logo, and all related names, logos, product and service names, designs, and slogans are trademarks of X Corp or its affiliates. You must not use such marks without the prior written permission of X Corp. TweetStream's use of 'Twitter' or 'Tweet' in describing our service is purely descriptive and nominative, referring to content originating from the Twitter/X platform. We claim no ownership or affiliation with these marks. All other names, logos, product and service names, designs, and slogans on this website are the trademarks of their respective owners.

3.3 Data Provider Disclaimer

Our service relies on third-party data providers to deliver content. These providers operate independently and maintain their own agreements with content sources. We do not guarantee the continued availability of any data provider relationship. In the event that any data provider relationship is terminated, modified, or disrupted for any reason, we reserve the right to modify, suspend, or discontinue affected features of our service without liability. You acknowledge that such changes may occur without prior notice and agree to hold TweetStream harmless for any resulting service disruptions.

3.4 Subscriptions, Payments, and Refunds

By subscribing to TweetStream, you agree to the following terms regarding payments and refunds:

• All subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan)
• Payments are generally non-refundable. We do not offer refunds or credits for partial subscription periods, unused features, or voluntary account termination. This policy does not exclude, restrict, or modify any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law or other applicable laws that cannot be excluded by contract.
• By subscribing, you consent to immediate access to our digital services and acknowledge that you waive any statutory cooling-off or cancellation rights that may otherwise apply
• You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of your current billing period, and you will retain access until that date
• We reserve the right to change subscription pricing with 30 days notice. Continued use after price changes constitutes acceptance of the new pricing
• Failed payment attempts may result in service suspension. You are responsible for maintaining valid payment information

If you believe you have been charged in error, please contact support within 7 days of the charge. We will review such requests on a case-by-case basis but are under no obligation to issue refunds.

4. User Conduct and Prohibited Uses

You agree not to use TweetStream to:

• Violate any applicable laws, regulations, or third-party terms of service (including Twitter/X Corp's Terms of Service)
• Infringe upon the intellectual property rights of others, including Twitter/X Corp
• Scrape, crawl, harvest, or systematically collect content in violation of platform terms
• Circumvent, disable, or interfere with any access controls, rate limits, or security features
• Redistribute, resell, or sublicense content obtained through our service without authorization
• Create derivative works or competing services using content obtained through our service
• Use automated systems to access content at volumes that exceed normal human usage patterns
• Distribute harmful, offensive, defamatory, or inappropriate content
• Attempt to gain unauthorized access to our service or any connected systems
• Use our service for any illegal, fraudulent, or unauthorized commercial purpose
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

5. Intellectual Property

TweetStream and its original content, features, and functionality are owned by TweetStream and are protected by international copyright, trademark, and other intellectual property laws.

6. Limitation of Liability

To the maximum extent permitted by applicable law, TweetStream and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, resulting from your access to or use of our service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claims arising from or related to these Terms or the service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.

7. Disclaimer of Warranties

TweetStream is provided on an "as is" and "as available" basis without any warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free.

8. Indemnification

You agree to indemnify, defend, and hold harmless TweetStream and its directors, officers, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; (d) your violation of any applicable law or regulation; (e) any claim that your use of our service violated Twitter/X Corp's Terms of Service, Developer Agreement, or any other Twitter/X Corp policies; (f) any claim by Twitter/X Corp or any third-party data provider related to your use of content obtained through our service; or (g) any content you submit, post, or transmit through the service. This indemnification obligation will survive the termination of these Terms and your use of the service.

9. Termination

We reserve the right to terminate or suspend your account and access to TweetStream immediately, at our sole discretion, without prior notice or liability, for conduct that we believe violates these Terms of Service or is harmful to other users, us, third parties, or our data providers. We will terminate accounts that:

• Resell, redistribute, or sublicense our services or content without explicit written permission
• Use our services for unauthorized commercial purposes or to build competing products
• Attempt to circumvent our service limitations, rate limits, or pricing
• Engage in any form of API abuse, scraping, or excessive automated usage
• Violate Twitter/X Corp's Terms of Service, Developer Agreement, or policies through our platform
• Expose us to potential legal liability from Twitter/X Corp or any data provider
• Use our service in any manner that could damage, disable, or impair our systems or data provider relationships
• Fail to comply with any provision of these Terms after being notified of non-compliance

Upon termination, your right to use the service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability. We maintain the right to investigate and take appropriate action against any account that we suspect of violating these terms, including immediate termination without refund and pursuit of legal remedies.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of any material changes by posting the new terms on the site. Your continued use of TweetStream after any changes indicates your acceptance of the modified terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any disputes arising from or relating to these Terms or your use of the service. Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction. Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by legislation that cannot lawfully be excluded or limited.

11.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

11.2 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and TweetStream regarding your use of the service. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter hereof.
